Parent Terms
These terms apply when you sign up as a parent or guardian and book classes for your children.
1. Who may sign up
You must be 18 or older and the parent or legal guardian of every child you add. You are responsible for everything done on your account, so keep your password private.
2. What Smart Funzi offers
Smart Funzi offers live online enrichment and holiday learning in small groups (up to 7 learners) or one to one. It supports, and does not replace, your child's school. Smart Funzi schedules every class and chooses the tutor. The tutor for a class may change, for example if a tutor is unwell or suspended; you will see the new tutor in your bookings.
3. Prices and payment
- Smart Funzi sets the prices, shown on the home page and when you book.
- When you choose classes, we hold the seats for 30 minutes while you pay. Your child's place is confirmed only once payment is received.
- You pay Smart Funzi through our payment provider (M-Pesa or card), or by another method we confirm with you. Never pay a tutor directly.
- You receive an email confirming each payment and the classes it covers.
4. Cancellations and refunds
- If Smart Funzi cancels a class, or cannot place your child in a class you paid for, we refund that class in full to the way you paid, or with your agreement give a credit for another class.
- If you need to cancel a paid class, contact us at least 24 hours before it starts. We will decide each request fairly. Classes missed without notice are not refunded.
5. Keeping children safe in class
- Your child joins only through the Smart Funzi class link. Classes never move to WhatsApp, Zoom or any other app.
- Please make sure a responsible adult is nearby during classes, especially for younger children.
- Nobody may record, photograph or screenshot a class, including parents and learners.
- Do not share phone numbers, emails, home addresses or social media with tutors, and do not arrange private lessons or payments with a tutor you met through Smart Funzi.
- Smart Funzi staff may join any class at any time to check it is safe and of good quality.
- If anything worries you, use "Report a concern" on any page. In an emergency call 999 or 112; Childline Kenya is 116.
6. Behaviour
Learners should be respectful in class. A tutor or Smart Funzi may remove a learner who disrupts a class; repeated problems may lead to the account being closed, with a refund for classes not yet taught.
7. Closing your account
You may ask us to close your account at any time. We may suspend or close an account that breaks these terms, especially the child safety rules.
8. Changes
We may update these terms. We will tell you before changes take effect, and the version you agreed to is recorded on your account.
Tutor Terms
These terms apply when you sign up and apply to teach on Smart Funzi.
1. Who may apply
You must be 18 or older, a qualified teacher, and registered with the Teachers Service Commission (TSC). Everything you tell us and every document you upload must be true, current and your own.
2. Vetting
- To be approved you must give your TSC number and upload your national ID, your professional certificate (degree, diploma or certificate), your CV and your TSC certificate. A certificate of good conduct is optional but strengthens your application.
- You agree that Smart Funzi may check your documents and details, including with the TSC and the institutions that issued them, and may interview you or ask for references.
- Approval is Smart Funzi's decision. You must tell us at once if your TSC registration is suspended or withdrawn, or if anything happens that could affect your suitability to work with children.
3. How classes are given
- You choose the hours you are free each week. Smart Funzi schedules the classes and shares them fairly among the approved tutors who are free.
- Smart Funzi may move a class to another tutor, for example if you are unavailable, or cancel a class. You will be emailed when a class is given to you, moved or cancelled.
- You are an independent tutor, not an employee of Smart Funzi.
4. Fees and payment
- Smart Funzi sets all class prices. You receive 70% of the fee for each paid learner in each class you teach; Smart Funzi keeps 30% to run the platform. The split for a booking is fixed when the parent books.
- You earn the fee once the class has taken place. Smart Funzi pays what you are owed periodically to your M-Pesa number and emails you a weekly statement while money is owed.
- If a class moves to another tutor, the fee goes to the tutor who teaches it.
- You are responsible for declaring your income and paying your own taxes.
- Never accept payment directly from a parent.
5. Conduct and child safety
- Before you can be given classes you must accept the Tutor Code of Conduct on your dashboard, and you must follow it at all times.
- Teach only in the Smart Funzi classroom. Never contact a learner or family outside it, never ask for their contact details, and never record, photograph or screenshot learners.
- Report any worry about a child the same day using "Report a concern".
- Smart Funzi staff may join any class without notice.
6. Your employment
If you are employed as a teacher, you are responsible for making sure your employer's rules and the TSC Code of Conduct allow you to teach on Smart Funzi. Do not teach learners from the school where you work through Smart Funzi.
7. Suspension and removal
Smart Funzi may suspend or remove a tutor who breaks these terms or the Code of Conduct, or where there is a concern about a child's safety. When a tutor is suspended, their upcoming classes move to other tutors. Fees for classes already taught are still paid, unless a class was not properly delivered.
8. Changes
We may update these terms. We will tell you before changes take effect, and the version you agreed to is recorded on your account.
Privacy notice
Smart Funzi handles personal data under Kenya's Data Protection Act, 2019.
What we keep
- Parents: your name, phone number and email, your bookings and payments.
- Children: first name and grade only, plus the classes they attend. We do not ask for a child's surname, school, photo or date of birth.
- Tutors: your name, phone number, email, TSC number, the documents you upload, your profile, availability, classes and payouts.
How we use it
- To run classes, take payments, pay tutors, send the emails described above, and keep children safe.
- Tutors see only the first names of learners in their own classes. Parents see the profile of their child's tutor (name, bio, qualifications, experience and subjects), never a tutor's documents, phone or email.
- Vetting documents are kept in a private store that only the tutor and the Smart Funzi team can open.
- We share data only with the services that run Smart Funzi (hosting, database, video classroom, payments and email), and never sell it.
Your rights
You may ask to see, correct or delete your data, or your child's, at any time. We keep data only while your account is open and for as long afterwards as the law requires (for example payment records).
